Here is a piece of arithmetic worth knowing before you negotiate. Federal rule sets the basic range for a payment standard at "any dollar amount that is in the range from 90 percent up to 110 percent of the published FMR for a unit size." Multiply the FY2026 three-bedroom FMR by 1.10 and you get $1,812.80 — which lands exactly on HACM's published $1,812 once you drop the cents. The same holds at every other bedroom size. HACM does not publish that as its policy anywhere we could open, so treat it as an observed calculation rather than an agency statement. But it tells you the ceiling is set at the top of the federal band, not the middle.

Layouts you will actually see: bungalow with attic bedroom, two-flat lower, four-square

Those are the shapes Milwaukee listings describe. Treat them as style labels, not verified data — we could not open a public housing-stock breakdown for the city that we would be willing to cite. What matters for your lease and your subsidy is not the architectural name but three concrete things:

  • How many bedrooms the unit is actually rented as. A finished attic room may or may not be counted. Get the number in writing before the showing.
  • Whether it is a flat in a two-family building. If so, the federal condition standard also reaches "the primary and secondary means of egress from a unit's entry door(s) to the public way" and shared residential features such as the laundry room — so the shared stairwell is inspectable.
  • Whether the building is owner-occupied with four units or fewer. If it is, Wisconsin's landlord-identification disclosure requirement does not apply to it. If it is not, you are entitled in writing to the name and an in-state address where legal papers can be served in person, plus notice of changes within 10 business days.

What a 3-bedroom HACM payment standard covers

The payment standard is the maximum subsidy, not a rent cap and not a check that arrives in your name. HACM states plainly that the housing assistance payment "is paid directly to the property owner or designated payee each month," and that the household pays approximately 30% of its income toward rent.

Your actual share is set by federal formula. Total tenant payment is the highest of: 30% of monthly adjusted income; 10% of gross monthly income; the housing portion of a welfare payment; or the minimum rent. Then, at initial occupancy only, a second rule bites — where gross rent exceeds the applicable payment standard, "the family share must not exceed 40 percent of the family's adjusted monthly income." Note the term is gross rent: rent to owner plus the utility allowance for what you pay yourself. A house listed at $1,500 with gas heat in your name is not a $1,500 unit for this test.

And the ZIP matters. HACM's 2026 tabulator applies the base standards to every ZIP except fifteen exceptions: 53129, 53130, 53132, 53154, 53202, 53203, 53207, 53211, 53213, 53217, 53223, 53224, 53226, 53227 and 53228. Two ZIPs renters ask about constantly, 53206 and 53210, are not on that list — the base $1,812 three-bedroom standard applies in both.

Bedroom size standards: when a household is issued a 3-bedroom voucher

HACM writes its own subsidy standards, but federal rule 24 CFR 982.402 constrains them, and the constraints are more useful than people realize:

  • The standards "must provide for the smallest number of bedrooms needed to house a family without overcrowding," and must be consistent with the space requirements in the condition standard.
  • They "must be applied consistently for all families of like size and composition."
  • A child temporarily away from home because of foster care placement counts toward family unit size.
  • A pregnant woman with no other household members is treated as a two-person family.
  • An approved live-in aide is counted in determining family unit size.
  • The authority "may grant an exception to its established subsidy standards" where justified by age, sex, health, handicap, relationship of family members, or other personal circumstances.

Then the number on your voucher meets the number on the door. Your payment standard is the lower of the standard for your family unit size and the standard for the unit you actually rent. A three-bedroom voucher used on a two-bedroom flat gets the two-bedroom standard. You are allowed to rent smaller — "the family may lease an otherwise acceptable dwelling unit with fewer bedrooms than the family unit size" — as long as the space requirement is still met. You are also allowed to rent larger, but then the utility allowance follows the rule at 24 CFR 982.517(d): the allowance used is for the lesser of the unit size leased or your family unit size. Utilities, heating and the utility allowance at three bedrooms

Wisconsin winters make the heating question the most expensive line in a three-bedroom lease. Ask first, in writing: is heat included, and what fuel?

HACM's 2026 utility allowance schedule comes in two grids, and on a page about houses the difference matters. For natural-gas heating at three bedrooms the allowance is $32 in a multi-family unit — an apartment in a building of three or more, or a duplex flat — and $46 in a detached single-family house, because a house has more exterior wall and more volume to heat. Across 0 to 6 bedrooms the multi-family ladder runs $21 · $24 · $28 · $32 · $36 · $40 · $43 and the detached-house ladder runs $29 · $34 · $40 · $46 · $52 · $58 · $62. Other fuels, cooking, water heating, water, sewer, trash, range and refrigerator each have their own rows on the same schedule; ask HACM which rows apply to the exact utility setup in the house you are considering, and confirm the current figures with them before you sign.

Federal rule requires the authority to maintain that schedule "for all tenant-paid utilities (except telephone)," classified into space heating, air conditioning, cooking, water heating, water, sewer, trash collection, other electric, tenant-supplied refrigerator, tenant-supplied range, applicable surcharges and other specified housing services. It gets reviewed annually and must be revised for any category where the utility rate has moved 10% or more since the last revision. Cable and satellite get nothing.

If heat is in your name, note that Wisconsin's home energy assistance program (WHEAP) runs a program year from October 1, 2025 to September 30, 2026, with the heating season running October 1 to May 15 and eligibility based on 60% of the state median income — $38,421 a year for one person, $73,888 for a household of four, up to $101,965 for eight. Apply early: the state warns that "WHEAP benefits are not guaranteed to eligible households. When funds for a program year are exhausted, no benefits are issued."

Yard, garage and driveway: what comes with the lot

Nothing in federal or Wisconsin law gives you a garage, a driveway, a fenced yard, or off-street parking — and nothing assigns lawn mowing or snow removal. All four are lease terms, and in Milwaukee the snow clause is not a detail. Settle it before signing.

What the condition standard does reach outside the walls: the building site, exterior components, fencing, retaining walls, grounds, lighting, mailboxes, parking lots, detached garage or carport, driveways, refuse disposal, walkways, roofs, foundations, windows and attached porches. Outside outlets within six feet of a water source must be GFCI protected, and any elevated walking surface with a drop of 30 inches or more needs a guardrail — which is exactly the back-porch condition that fails inspections.

Use Wisconsin's pre-tenancy tools on the exterior too. Before accepting a security deposit, the landlord must notify you in writing that you may inspect the unit and report preexisting damage, with a deadline no less than 7 days after the start of tenancy; Wis. Stat. 704.08 separately requires a check-in sheet at move-in with 7 days to return it. Photograph the gutters, the porch rail and the driveway.

Documents and income proof for a 3-bedroom application

Screening is the owner's job even in a voucher tenancy. Federal rule: "the owner is responsible for screening and selection of the family to occupy the owner's unit," and specifically for screening on tenancy history. The factors the rule names are examples rather than a closed list: payment of rent and utility bills, care of the unit and premises, respecting other residents' peaceful enjoyment of their housing, drug-related or other criminal activity that threatens the health, safety or property of others, and compliance with other essential conditions of tenancy. The authority must hand the owner your current and prior address, and those landlords' contacts if it knows them.

Wisconsin puts a hard cap on one fee: a landlord may charge their actual cost, up to $25, for a consumer credit report, must disclose the charge before pulling it, and must give you a copy. Supply your own report from a credit reporting agency that maintains files nationwide, dated within the last 30 days, and they cannot charge it at all.

Know the deposit rules before you hand over money. Any prepaid rent above one month is legally a security deposit. Deductions are limited to a closed list, normal wear and tear is excluded, and if any amount is withheld the landlord must send a written statement describing each item and the amount withheld for each — within the same 21-day window as the return. If they get it wrong and you lose money, Wisconsin lets you sue directly and recover twice the loss plus costs and reasonable attorney fees. Booking a showing and what happens after you apply

After you apply on a voucher, the sequence is fixed: request for tenancy approval, inspection, rent reasonableness, lease and contract. The authority may not approve the tenancy or execute the contract until the unit is eligible, has been inspected and passes, the lease includes the tenancy addendum, the rent to owner is reasonable, and the 40% initial-occupancy test is satisfied. Inspection and notice are due within fifteen days of submission at an authority with up to 1,250 budgeted tenant-based units, and within a reasonable time — with those same fifteen days as the target, to the extent practicable — at a larger one; either way the clock is suspended whenever the unit is unavailable for inspection, and thereafter the authority must inspect at least every two years during assisted occupancy, and within 24 hours of notice of a life-threatening deficiency.
